ICC Deputy Prosecutor Nazhat Shameem Khan Says Darfur Investigation Reaches Major Breakthrough

The International Criminal Court (ICC) has made a significant breakthrough in its investigation into alleged crimes committed during the conflict in Sudan’s Darfur region, according to Deputy Prosecutor Nazhat Shameem Khan.

Reuters reported that investigators have obtained new evidence linking alleged atrocities in Darfur to senior leadership levels, marking an important development in one of the court’s most closely watched investigations.

The breakthrough comes as the ICC continues examining attacks on the cities of Al Geneina in 2023 and Al Fashir in 2025, where United Nations experts have previously alleged that crimes bearing the hallmarks of genocide were committed against non-Arab communities.

Speaking after meeting victims in eastern Chad, ICC Deputy Prosecutor Nazhat Shameem Khan said the new evidence represents a major step forward in efforts to establish accountability for crimes committed during the conflict.

According to Reuters, Khan said investigators have secured additional evidence linking events in Darfur to leadership structures, describing the development as a significant breakthrough for the prosecution.

“We have got additional evidence, strong evidence, linking what is occurring in Darfur with leadership levels. And we are very, very pleased to say that this is a breakthrough for us,” Khan told Reuters.

She declined to identify the individuals or groups involved, noting that ICC rules prevent prosecutors from discussing potential arrest warrants or ongoing legal procedures.

Reuters reported that prosecutors are investigating attacks on Al Geneina and Al Fashir, two cities that witnessed some of the most intense violence during Sudan’s conflict.

The ICC is also gathering testimonies from survivors who have described executions, sexual violence, and other alleged atrocities committed during the attacks.

Khan said the court remains committed to ensuring that victims’ experiences are presented during future legal proceedings.

What This Means For Africa

The latest development represents an important milestone for international justice efforts relating to one of Africa’s most devastating humanitarian crises.

For ICC Deputy Prosecutor Nazhat Shameem Khan, the emergence of evidence connecting alleged crimes to leadership levels could strengthen the court’s ability to pursue accountability in complex conflict situations where establishing command responsibility is often one of the greatest legal challenges.

Reuters reported that the ICC’s jurisdiction over Darfur stems from a United Nations Security Council referral covering alleged atrocity crimes committed in the region since 2005.

Although Sudan is not a member of the Rome Statute, the referral enables the court to investigate individuals suspected of committing crimes within its mandate.

The investigations continue as Sudan’s conflict enters another year, with millions of people displaced and humanitarian conditions remaining severe across large parts of the country.

Reuters also noted that the court has not yet issued any public arrest warrants relating to the current conflict, although investigations remain ongoing.

Beyond Sudan, the developments highlight the continuing role of international justice institutions in addressing allegations of war crimes, crimes against humanity, and genocide across Africa.

As investigators continue gathering evidence and engaging with victims and witnesses, the outcome of the Darfur investigations will remain closely watched by governments, humanitarian organisations, legal experts, and communities seeking accountability for atrocities committed during the conflict.
